In a speech on the Floor of the House of Representatives in 1999, Congressman Dingell warns against repealing the Glass-Steagall Act of 1933. He argues that repealing the law would allow banks to become "too big to fail," which would cause instability in financial system. Nonetheless, Congress repealed the law and the nation suffered the tragic consequences of the 2008 financial crisis about a decade later.

The Dodd-Frank Wall Street Reform and Consumer Protection Act was aimed at correcting a number of problems relating to the market woes of the last few years. Among other things, it specifically sought to address issues pertaining to the idea that some entities were too big and intertwined with the economy to be allowed to fail. Our panel will discuss the legal (and potential constitutional) issues coming out of Dodd-Frank. In passing the act, has Congress overstepped its bounds? Will Dodd-Frank succeed in identifying the entities that are "too big to fail," and will it be effective in regulating them in a way that will prevent their failure? He has reportedly amassed derivative positions so large that he's driving price moves in the $10 trillion market for credit derivative indexes. Is this yet another sign that too big to fail banks are taking outsized risks with federally insured money? Would they take this huge positions that have the ability to drive price movements in this fashion if they didn't know that their very existence was subsidized and that they had an implicit backstop from the central banks?
